These are the rules for using Bayda, a training, running and nutrition tracker for iOS. They are written to be read. If something here is unclear, write to the contact address below.

By creating an account or using Bayda, you agree to these Terms of Use and acknowledge the Privacy Policy, which says what Bayda stores about you and why. If you do not agree, please do not use Bayda.
You must be at least 16 years old. Bayda is not intended for anyone younger and should not be used by them. By using Bayda you confirm that you are 16 or older and that you are allowed to enter into this agreement where you live.
You sign in with Apple or Google. Bayda has no passwords of its own. You are responsible for what happens under your account, so keep your Apple or Google sign-in safe, and tell us if you think someone else is using it. Give accurate information when Bayda asks for it, and pick a username that does not break the rules below.
You can delete your account at any time in the app: Profile, Settings, Data & account, Delete my account. Deleting it erases your data as described in the Privacy Policy.
Bayda has a social side. You can post workouts, runs and other activities, photos, comments and profile details such as a username, display name and picture. You choose who can see your activities with Profile, Sharing. Your food diary, weight, body measurements and targets are never shared with anyone.
You own what you post. To run the service, you give Bayda a worldwide, non-exclusive licence to store and display your content to the audience you choose, and to resize or reformat it so it fits on screen. This licence exists only to operate Bayda, and it ends when you delete the content or your account, apart from short delays in backups and in copies already shown to others. You promise that you have the right to post what you post.
There is no tolerance for objectionable content or abusive users. Do not post, send or share:
What happens if the rules are broken. We may remove content, hide it, limit what an account can do, suspend the account, or end it, with or without warning when the breach is serious. If we end your account for a breach, you may not create a new one to get around that.
Blocked words. Comments, display names and usernames that contain a word on a blocklist are refused automatically when you try to save them. Nothing is posted and nothing is stored. The check is a floor and not a moderator, so reports and blocking stay.
Reporting and blocking. In the app you can report a post, comment or profile, and you can block any user, which stops them from following you, tagging you, finding you in search and seeing your workouts. Reports are reviewed and acted on. If you see something that breaks these rules, please report it. If you think we got something wrong, write to the contact address and we will look again.
The app is licensed to you under Apple's Standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula). These Terms add to that agreement and do not replace it. If the two disagree about the app itself, Apple's agreement applies to that point.
Bayda is a tracking tool. It is not medical advice and does not replace a doctor, dietitian or qualified trainer. Calorie, macro and nutrition figures, calculated targets and estimates of energy burned are estimates, and so are the figures from the AI food scan, which reads a photo of a meal and guesses what is on the plate and in what amount. They can be wrong, sometimes by a lot. Check them before you rely on them.
Talk to a professional before you change your diet or start or increase exercise, especially if you have a medical condition, are pregnant, or have had an eating disorder. Stop and seek help if you feel unwell. You use Bayda and its numbers at your own risk.
If you use the food scan, your photo is processed as the Privacy Policy describes, and you can turn the feature off in Settings. Do not scan photos of other people.
Some food data and artwork in Bayda come from other sources, with their own licences. They are credited in the in-app food data sources page and in the project's third-party notices (legal/third-party-notices.md).
Please do not:
Bayda, its code, design, name, logo and the content we make belong to David Bayard or to those who license them to us. These terms give you a personal, non-transferable right to use the app on your own devices for as long as you follow these terms. They give you no ownership of the app, and you may not copy or sell it. Your own content stays yours.
You can stop at any time by deleting your account. We may suspend or end your access if you break these terms, if the law requires it, or if we stop running Bayda. If we stop the service, we will give notice in the app first whenever we can.
Bayda does not currently sell anything. If purchases or subscriptions are added later, their price, billing and cancellation terms will be shown to you at the moment of purchase, before you pay, and will apply in addition to these terms.
We may update these terms. A material change will be announced in the app before it takes effect, and the date at the top of this page shows the current version. If you keep using Bayda after a change takes effect, you accept the new terms. If you do not, you can delete your account.
Bayda is provided as it is. We work to keep it running and accurate, but we do not promise that it will always be available, free of mistakes or suited to your needs, and the app is still being built. To the extent the law allows, we are not liable for indirect or consequential loss, for loss of data or for what other users post. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud or for intent, or your rights as a consumer under mandatory Belgian and European law.
These terms are governed by Belgian law. If you are a consumer, you keep the protection of the mandatory consumer rules of the country where you live, and you may bring a claim in the courts where you live. Otherwise the courts of Belgium have jurisdiction. If a part of these terms turns out not to be enforceable, the rest still applies.
